Overview
Peru views the multilateral mechanism and the Cali Fund as complementary to national ABS regimes, and describes benefit-sharing from DSI as a substantive obligation and a pillar of the Convention, not an option. Its negotiators reject framing contributions as donations, arguing that benefit-sharing is a right and an obligation rather than charity, and Peru supported Brazilโs amendments on the Fundโs MoU at SBI-7. Its existing ABS framework already covers DSI, with royalties of at least 1% of net sales for commercial use, and it considers that the mechanism should apply mainly where the origin of the genetic resource is unknown or shared between countries. At SBI-6, with Guatemala, it proposed criteria on traceability, IPLC participation and DSI for specialised ABS instruments.
Goals
- Establish benefit-sharing from DSI as an obligation, not a donation
- Apply the mechanism mainly to DSI of unknown or shared origin, preserving national ABS regimes
- Align the Fundโs MoU with Decision 16/2 and the COPโs authority
- Build traceability and IPLC participation into ABS instruments
