Overview

Spain has not adopted Cali Fund-specific legislation or administrative measures. It maintains a formal reservation on Decision 16/2 because benefits under the multilateral mechanism can flow only to developing countries, excluding developed provider countries such as Spain that regulate access to their genetic resources.

Proposed legislation / administrative measure

No measure has been proposed. Spain's existing access regime under Royal Decree 124/2017 is unaffected, and patent applications have served as a checkpoint since 2017.

Key developments

5 November 2025 - MITECO adopted the National Plan for ABS compliance control.

4 February 2025 - Spain ratified the BBNJ Agreement.

ABS legislation

Law 42/2007 on Natural Heritage and Biodiversity (articles 5 bis, 71 and 80); Royal Decree 124/2017 on access to genetic resources from wild taxa and control of their use; Royal Decree 429/2020 on plant genetic resources for food and agriculture; Regulation (EU) No 511/2014 and Implementing Regulation 2015/1866; MITECO Resolution of 5 November 2025 adopting the National Plan for ABS compliance control.

Regulatory context

Spain regulates access to genetic resources from wild taxa under Royal Decree 124/2017, with prior informed consent and mutually agreed terms granted by MITECO or the autonomous communities, and Royal Decree 429/2020 covers plant genetic resources for food and agriculture. User compliance follows Regulation (EU) No 511/2014, with several checkpoints including patent applications, and a national compliance-control plan adopted in November 2025. DSI is not covered.
